At this stage, what should you prioritize? Each spouse\u2019s <strong>share<\/strong> (legal aspect) and each spouse\u2019s <strong>down payment<\/strong> (financial aspect) are key.<\/p>\n<h4>\u00a0<\/h4>\n<h4>What is a share?<\/h4>\n<ul>\n<li>The share determines <strong>each spouse\u2019s<\/strong> <strong>responsibility for expenses<\/strong>.<\/li>\n<li>According to the <strong>Civil Code of Qu\u00e9bec<\/strong>, the <strong>shares<\/strong> of co-owners are presumed to be <strong>equal<\/strong> (50% each), unless unequal shares have been agreed upon between them.<\/li>\n<li>The <em>Civil Code<\/em> also provides that co-owners must <strong>pay<\/strong> the <strong>ownership expenses<\/strong> according to their respective shares, with a <strong>larger share<\/strong> meaning a <strong>heavier financial burden<\/strong>. That\u2019s why it\u2019s important to establish these shares from the outset, as they will have an impact when the home is sold or in the event of a separation.<\/li>\n<li>Each spouse\u2019s share must be decided <strong>by the couple<\/strong>, and a frank discussion is the best way to reach an agreement.<\/li>\n<li>There is indeed <strong>no one-size-fits-all solution<\/strong>, and each couple is free to agree on the arrangement that works best for them.<\/li>\n<li>For example, the share could be based on each spouse\u2019s <strong>disposable income<\/strong> (after taxes and social security contributions), but other factors may also come into play, particularly each spouse\u2019s <strong>financial obligations<\/strong> (outstanding debt relative to income).<\/li>\n<li>Bear in mind as well that <strong>mortgage payments<\/strong> are just one of <strong>many expenses<\/strong> associated with home ownership: there are also property taxes, home insurance, condo fees, maintenance costs, repairs\u2026<\/li>\n<li>Even if the spouses decide on unequal shares, it\u2019s important to know that most <strong>financial institutions<\/strong> require <strong>each spouse<\/strong> to be jointly and severally, or <strong>solidarily<\/strong>, <strong>responsible<\/strong> for the mortgage, meaning that <strong>each <\/strong>is obligated to pay the <strong>entire loan<\/strong> in the event of the other spouse\u2019s default.<\/li>\n<\/ul>\n<h4>\u00a0<\/h4>\n<h4>Unequal down payments<\/h4>\n<ul>\n<li>It is essential to document in writing an <strong>unequal down payment<\/strong> and to agree on how each spouse will recover this down payment when the home is <strong>sold<\/strong>, including how the <strong>proportional appreciation<\/strong> generated by the down payment will be handled.<\/li>\n<li>Here again, discussing this issue as a couple will help you reach an agreement.<\/li>\n<\/ul>\n<h4>\u00a0<\/h4>\n<h4>Your essential legal documents: agreements<\/h4>\n<p>There are two key agreements in which the details of the purchase must be recorded:<\/p>\n<ul>\n<li>The <strong>purchase agreement<\/strong> \u2013 The exact share of each spouse is recorded in the agreement by a notary. This document is filed with the land registry and is therefore on public record.<\/li>\n<li>The <strong>cohabitation agreement<\/strong> \u2013 The share and\/or unequal down payment of each spouse is set forth in the agreement either by the couple or by a legal professional. The cohabitation agreement may also include other provisions such as:\n<ul>\n<li>The terms for partitioning all the property between the spouses in the event of a separation (not just the jointly owned property).<\/li>\n<li>A list of each spouse\u2019s assets and liabilities at the start of their cohabitation.<\/li>\n<li>Clauses regarding the terms of ownership of the property purchased by the couple (proportion of the ownership expenses to be paid by each of the spouses), contribution from a parent of one of the spouses (inheritance or gift).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>N.B.: <\/strong>These documents do not allow you to <strong>bequeath your share<\/strong> to your spouse in the event of death: such a provision must be included in a <strong>will<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<h4>What happens when one of the spouses dies?<\/h4>\n<ul>\n<li>In such case, the <strong>rules of legal devolution<\/strong> (set forth in the <em>Civil Code<\/em>) apply to determine the <strong>heirs <\/strong>of a person who dies intestate, that is, <strong>without a will<\/strong>.<\/li>\n<li>These rules of legal devolution depend on several factors:\n<ul>\n<li>the civil status of the deceased (married, single, divorced, widowed)<\/li>\n<li>the existence of a prenuptial agreement<\/li>\n<li>whether the couple have children together (parental union regime)<\/li>\n<li>A <strong style=\"font-size: 16px;\">surviving spouse<\/strong><span style=\"font-size: 16px;\"> may receive only one-third or two-thirds of the estate, or may not be legally entitled to anything at all if <\/span><strong style=\"font-size: 16px;\">their spouse<\/strong><span style=\"font-size: 16px;\"> dies <\/span><strong style=\"font-size: 16px;\">intestate<\/strong><span style=\"font-size: 16px;\">.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>If <strong>married spouses<\/strong> do not have a marriage contract containing a <strong>conventional appointment clause<\/strong> (better known as a \u201c<strong>surviving spouse<\/strong>\u201d clause) and if they have <strong>no will<\/strong>, the <strong>surviving spouse<\/strong> generally inherits only <strong>a share<\/strong> of the estate.<\/li>\n<li>For the <strong>surviving spouse<\/strong> to inherit the deceased spouse\u2019s <strong>entire share<\/strong> of the property (and even of their estate), a <strong>will<\/strong> is required. This avoids a situation where the surviving spouse ends up being a co-owner with their in-laws or even with their minor children\u2014situations best avoided!<\/li>\n<\/ul>\n<p><strong>N.B.:<\/strong> In the case of <strong>married or civil union<\/strong> spouses, the <strong>family patrimony rules<\/strong> apply as a matter of public policy and are therefore <strong>mandatory<\/strong>. A married or civil union spouse may be entitled <strong>by priority<\/strong> to a portion of the property\u2019s value upon death, even if they do not inherit any share of the property. The same reasoning applies to spouses subject to the <strong>parental union regime<\/strong> in effect since June 30, 2025.<\/p>\n<p>&nbsp;<\/p>\n<div class=\"chapeau\">\n<p>Buying a home as a couple is an excellent time to review your financial plan and make sure all your important documents are up to date in case of unforeseen circumstances.
